Terms of service

Last updated: 2 November 2026

1. Provider and scope

TellCAD is provided by SweetWater Holding UG (haftungsbeschränkt), Bunsenstraße 1, 22765 Hamburg, Germany, registered with the Amtsgericht Hamburg under HRB 182540 (“we”, “us”; see the Impressum). These terms apply to every use of TellCAD. Information on data processing is in the privacy policy.

2. The service

TellCAD is an AI-assisted, browser-based CAD tool, currently offered free of charge as a beta. It is provided “as is” and “as available”. There is no entitlement to access, to activation of an account, to particular features or to any level of availability, performance or support, and no service level applies.

We may change, restrict, suspend or discontinue the service or individual features (including AI models and usage limits) at any time, and end the beta. Where this materially affects existing accounts, we will give reasonable notice where possible.

3. Account

You must be at least 16 years old. Accounts are personal; you are responsible for keeping access to your sign-in method secure and for activity under your account. We may delete accounts that have been inactive for an extended period, and free accounts generally, after notifying you by email with a reasonable period to export your data.

4. Your content

TellCAD itself (the software, its design, the AI instructions and templates) remains ours; these terms only give you the right to use it. The content you create or upload with TellCAD (models, code, drawings, files, pictures, comments) remains yours: you keep all rights you have in it, and we claim none beyond the licence in this section. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your content to the extent necessary to operate and provide TellCAD, including transmission to AI providers when you use the assistant and to manufacturing services when you choose to send files to them.

Sharing: people you invite to a model can view and edit it. If you publish a model via a public link, you allow anyone with the link to view the model, its code and parameters, download the displayed mesh, comment on it and create a copy for their own use within TellCAD (“remix”). These permissions apply only to models you choose to publish via a public link. Deleting the link ends access through it; copies already made are not affected.

You are solely responsible for your content and confirm that you hold the rights required for it.

Indemnity: you indemnify us against claims by third parties arising from your content, from parts or products you manufacture, sell or use based on it, or from your breach of these terms, including infringement of intellectual property or other rights, and against the reasonable costs of legal defence, unless you are not responsible for the breach.

Backups: we are not obliged to keep backups of your content. Keep your own copies of anything important; TellCAD lets you export your models.

5. AI output and engineering results

Models, code, drawings, bills of materials, cut lists, prices, dimensions and engineering figures (e.g. strength, stability, hydrostatics, buoyancy) are generated automatically and may be incorrect, incomplete or unsuitable.

You are solely responsible for verifying any design, by a qualified person where appropriate, before you manufacture, build, buy, sell or otherwise use or rely on it. TellCAD does not replace professional engineering, testing, certification or approvals required by law.

Subject to section 9, we give no warranty that AI output or other results are correct, complete, fit for a particular purpose, dimensionally accurate, structurally or hydrostatically sound, manufacturable, compliant with standards or regulations, or free of third-party rights. Similar output may be generated for other users. Subject to section 9, we are not liable for any damage resulting from the manufacture, use, sale or other exploitation of models, drawings, parts or products created with TellCAD, or from reliance on them.

6. Third-party manufacturing services

TellCAD can send model files you select to third-party manufacturing services (currently Craftcloud, a service of All3DP GmbH) so that you can obtain quotes and order parts. We only provide a link to the provider and, at your request, transmit the files. Any order is a contract solely between you and the provider, on the provider’s terms. We are not a party to it and have no influence on the provider’s prices, availability, production, quality, delivery, payment or customer service.

You are responsible for checking that your model is complete, correctly dimensioned and suitable for the chosen process and material before you order. Automatic checks in TellCAD (e.g. for closed solids or unusual sizes) are aids only. Subject to section 9, we are not liable for the prices, quality, delivery or other performance of third-party providers, or for the suitability of your model for printing or other manufacturing.

We may receive a commission or other remuneration from providers for orders placed after using such a link.

7. Acceptable use

You must not use TellCAD to:

8. Removal of content, suspension and termination

We may remove, hide or block content, and restrict, suspend or terminate accounts, if we have reason to believe that they violate these terms or the law, or where required by law. Content may be reported with the Report buttons or by email to [email protected]; after several reports, content may be hidden automatically pending review. Where required by law, we inform affected users of such decisions and the reasons.

9. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we have assumed a guarantee or fraudulently concealed a defect.

As the service is provided free of charge, our liability for slight negligence is otherwise excluded to the extent permitted by law. Where liability for slight negligence cannot be excluded, we are only liable for breach of an essential contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose fulfilment you may regularly rely), limited to the damage that is foreseeable and typical for this type of contract.

Liability for loss of data is limited to the effort that would have been required to restore it had you kept regular copies.

These limitations also apply in favour of our employees, representatives and agents.

10. Termination

You may stop using TellCAD at any time. You can delete your cloud data in the app (“Delete my account data”) and request deletion of your account at [email protected]. We may terminate the use of TellCAD by giving reasonable notice, and terminate it without notice for good cause, in particular for violations of section 7.

11. Changes to these terms

We may amend these terms for good reason, e.g. changes to the service or to the law. We will notify you of material changes by email or in the app in advance. If you do not agree, you can stop using TellCAD before the changes take effect.

12. Applicable law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Hamburg, Germany.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
